ZenAlgo's Terms & Conditions

1. Introduction

Welcome to our platform/webpage zenalgo.io, operated by KUMAMI Solutions s.r.o., Jurečkova 1811/18, Moravská Ostrava, 702 00, Czech Republic, ID: 11742739, registered with the Regional Court of Ostrava, file no.: C 86731 (hereinafter "ZenAlgo", "we", "us" and "our"). By accessing or using our platform, you agree to these Terms & Conditions ("Terms"), which apply to all visitors and users.

2. Services

ZenAlgo provides tools for traders and investors, including premium TradingView indicators and analytics, real-time data insights, and customizable trading signals. Users can subscribe to various plans to access these tools. We may modify or discontinue any feature, service, or product at our discretion without prior notice. The platform is provided “as-is” and “as-available.” Any new features or tools added are also subject to these Terms.

3. Accounts

To use our services, you must create an account with accurate information and keep your credentials confidential. You are responsible for all activity under your account and must promptly notify us of any unauthorized access. Using accounts for illegal or unauthorized purposes is prohibited. You agree to keep your information current.

3.1 Privacy & Data Portability (summary)

We process only limited account/access data necessary to operate the service; payment data are handled by authorized providers (e.g., Stripe). Under the EU Data Act, users may request access to service-generated user data in a structured, commonly used and machine-readable format; this does not extend to ZenAlgo proprietary IP (algorithms, indicators, trading signals). For scope, legal bases, retention, recipients, security, and the request process, see our Privacy Policy.

4. Paid Plans & Payments

We offer paid subscription plans as detailed on zenalgo.io/#pricing (“Pricing Page”). Features, benefits, and prices for each tier (e.g., monthly, annual, lifetime) on the Pricing Page are authoritative and may change at ZenAlgo's discretion. Review the Pricing Page before purchase or renewal.

Payments are processed via Stripe or other authorized providers. Unless stated otherwise, subscriptions auto-renew at the end of the billing cycle unless cancelled before renewal via your account settings. For annual plans, we do not send pre-renewal reminders. Refunds are only as outlined in our Refund Policy. We do not accept cryptocurrency payments.

4.1 Access to Stream Archives

No subscription tier (monthly/annual/lifetime) includes access to the stream archive. Archive access is a separate one-time purchase (USD 29) granting lifetime access to past/future streams, subject to 4.3 (definition of “lifetime”).

4.2 1h Private Coaching in Platinum Tier

“1h private coaching” means a non-public introductory session focused on ZenAlgo indicators. It is not guaranteed 1:1; multiple active Platinum users may attend. Content, format, and availability are at ZenAlgo's discretion and may change; the Pricing Page is authoritative.

4.3 Lifetime Pricing Conditions

“Lifetime” refers to the operational lifetime of ZenAlgo or the specific service offering—not the subscriber's lifetime. If ZenAlgo ceases operations, discontinues the platform, or terminates the specific service, access ends without refund, unless required by law. Features in lifetime plans may change at ZenAlgo's discretion per the Pricing Page. Affiliate notice: Payments for lifetime plans are not eligible for affiliate rewards (see 4.5.2) unless ZenAlgo expressly states otherwise in writing.

4.4 Marketing Promotions and Discounts

Promotional prices apply only for the stated promotional period and then revert to standard pricing on renewal or subsequent purchase, unless expressly stated otherwise.

4.5 Affiliate Program

ZenAlgo operates an affiliate program under the following terms, unless explicitly stated otherwise:

4.5.1 Payouts and form of reward

Rewards for referrals are typically paid monthly in Stripe credits. The reward amount is 10% of each qualifying payment made by a client who joined via your unique affiliate link. Credits can be used only to pay for ZenAlgo services and cannot be withdrawn or bank-transferred.

4.5.2 Subscriptions only

Affiliate rewards are paid solely on qualifying, recurring subscription payments. Rewards do not apply to one-time/non-recurring payments, including lifetime purchases, donations/tips, one-off fees (e.g., stream archive), or any future non-subscription products or fees, unless ZenAlgo expressly states otherwise in writing.

4.5.3 Ineligible, refunds, and abuse

ZenAlgo may deny, reverse, or claw back rewards for refunded/charged-back/fraudulent/self-referred or non-compliant transactions.

4.5.4 Program-specific terms

Details such as cookie window, thresholds, timing, and promotional rules may be set in separate affiliate documentation; if there is a conflict, those terms prevail for the affiliate program.

4.6 Platinum Tier Lifetime — Training Benefit

Platinum Tier Lifetime includes, in addition to lifetime feature access, 16 hours of training per participant, delivered by default in a small-group format (≥ 1:2; typically 1:2-1:5). Format, breakdown into blocks, and scheduling are determined by ZenAlgo (subject to availability) and coordinated with participants. A 1:1 format may be provided only if mutually agreed between ZenAlgo and the participant. Training is conducted via Discord or another medium designated by ZenAlgo. For clarity: the 16 hours are measured as elapsed session time per participant.

4.7 Additional Training on Trading/Indicators

Users may purchase additional training beyond the standard package:

  • USD 250 per hour in a 1:1 format,
  • USD 150 per person per hour for group training (min. 2, max. 10 participants). Group format depends on availability and topic suitability. All training is via Discord or another designated medium. Payment in advance is required. For clarity, such one-time training payments are not eligible for affiliate rewards (see 4.5.2) unless ZenAlgo states otherwise in writing.

4.8 Donations & Voluntary Contributions (AML/CTF)

4.8.1 Nature of donations

“Donations” or “voluntary contributions” are optional, non-recurring payments made without any entitlement to goods, services, or benefits beyond public acknowledgment at our discretion. Donations are non-refundable unless required by applicable law.

4.8.2 No affiliate rewards.

Donations (and other one-time/non-subscription payments) are not eligible for affiliate rewards (see Section 4.5.2), unless ZenAlgo expressly states otherwise in writing.

4.8.3 Lawful source of funds

By making a donation, you represent and warrant that the funds originate from lawful sources, are not proceeds of crime, and are not intended for money laundering, terrorist financing, sanctions evasion, fraud, or any other illegal activity. You further confirm you are not subject to sanctions by the EU, UN, UK, or US authorities.

4.8.4 AML/CTF screening and KYC

ZenAlgo may conduct AML/CTF screening and request KYC information (e.g., identity, residency, beneficial ownership, source of funds). We may delay, refuse, or reverse a donation, and/or report suspicious activity to competent authorities, if required by law or at our reasonable discretion.

4.8.5 Payment processing

Donations are processed via our authorized payment providers (e.g., Stripe). Processing fees and exchange charges are non-refundable. If a donation is reversed or returned, it may be net of fees retained by the processor or intermediary banks.

4.8.6 Tax and receipts

ZenAlgo is not a charitable organization and donations are not tax-deductible unless explicitly stated under applicable law. We may issue a payment receipt, but it does not constitute a charitable donation receipt.

4.8.7 No circumvention; limits

We may set minimum/maximum donation amounts, block split-payments, or reject patterns that appear designed to circumvent pricing, AML/CTF controls, or other policies.

4.8.8 No entitlement to access

Donations do not create or modify access rights to our services (see Section 2 and 4); access is governed solely by your active subscription or separately purchased products.

5. Trading Signals (ZenAlgo and Community)

5.1 Nature of Signals

  • 5.1.1 Within the service, users may be provided with so-called trading signals (“Signals”), either directly by ZenAlgo or by community members via platforms such as Discord or Telegram.
  • 5.1.2 Signals represent solely the sharing of information about our own trading entries and exits or entries and exits of community members.
  • 5.1.3 Signals are provided exclusively for informational and educational purposes and do not constitute investment advice within the meaning of applicable laws and regulations.

5.2 User Decisions

  • 5.2.1 Each user makes an entirely independent decision as to whether or not to use any Signal by ZenAlgo or by community members via platforms such as Discord or Telegram.
  • 5.2.2 Any use of a Signal (e.g. BUY/SELL, LONG/SHORT, entry into futures or perpetual contracts) is entirely at the user's own risk and responsibility.
  • 5.2.3 Neither ZenAlgo nor the authors of Signals determine whether or how the user should act.

5.3 Trading Risks

  • 5.3.1 Trading in financial instruments, especially cryptocurrencies, equities, futures, perpetual contracts and other leveraged derivatives, is highly risky.
  • 5.3.2 The user expressly acknowledges the possibility of:
    • complete loss of the invested amount,
    • rapid liquidation of a trading position when leverage is used,
    • incurrence of additional losses exceeding the funds originally deposited,
    • technical or operational failures (delayed delivery of a Signal, internet outages, exchange errors, slippage, incorrectly placed orders).
  • 5.3.3 Past performance of Signals is not indicative of future results.

5.4 Liability

  • 5.4.1 Neither ZenAlgo nor the authors of Signals shall bear any liability for losses, damages, lost profits or account liquidation arising from the use of Signals.
  • 5.4.2 The authors of Signals (community members) are protected under the same provisions as ZenAlgo and shall not be liable to users for the consequences of using Signals.
  • 5.4.3 All responsibility lies exclusively with the user.

5.5 Use of Signals / Prohibition of Disclosure

  • 5.5.1 All Signals shared via ZenAlgo or community platforms are intended solely for the personal use of the user.
  • 5.5.2 It is prohibited to copy, distribute or make Signals available to third parties without the prior explicit written consent of ZenAlgo. Signals are intended only for personal use of the user.
  • 5.5.3 The following are strictly prohibited:
    • selling, reselling or otherwise monetizing Signals,
    • sharing Signals within the user's own paid service, group, newsletter, application or bot,
    • mass-forwarding or publishing Signals,
    • representing Signals as one's own or using the name/identity of ZenAlgo for commercial purposes.
  • 5.5.4 In case of violation of this prohibition, ZenAlgo is entitled to immediately restrict or terminate access to the service and to take legal action. The user acknowledges that in such a case there is no entitlement to a refund and compensation for damages may be claimed.

6. User Responsibilities

Users must comply with applicable laws and regulations while utilizing our platform. You are responsible for all trading decisions made using our tools and acknowledge that trading carries inherent risks. Do not use the platform for illegal purposes or to transmit harmful content, including viruses or malicious code. Any breach of these responsibilities may result in immediate suspension or termination of services.

7. Intellectual Property Rights (IPR)

7.1 ZenAlgo Content

All content, software, code, algorithms, indicators, Pine scripts, databases, UI/UX, visuals, texts, documentation, training materials, recordings, examples, templates, Signals and any other materials made available via the services (collectively, “Content”) are protected by IP laws. All rights are owned by ZenAlgo or its licensors; no ownership transfers to users. All rights not expressly granted are reserved. “ZenAlgo” names/logos are trademarks; no trademark licence is granted without prior written consent.

7.2 Community-Created Content (User Content)

By creating or making available content within the services or community spaces (e.g., Discord/Telegram)—including Signals (collectively, “User Content”)—the author assigns to ZenAlgo all rights (to the maximum extent permitted). Where assignment is not possible, the author grants ZenAlgo an exclusive, perpetual, irrevocable, worldwide, transferable, sublicensable, royalty-free licence to fully exploit the User Content. The author waives (or, where non-waivable, agrees not to assert) moral rights except where attribution is required by law. The author represents/warrants they own/control the rights and that submission/use does not infringe law or third-party rights, and agrees to indemnify ZenAlgo for related claims.

7.3 User Rights to Content

Users may use Content only for personal purposes and strictly per these Terms. Users must not copy, distribute, make available, sell, resell, sublicense, rent, lease, assign or otherwise commercially exploit Content (including Signals/indicators) without prior written consent. Use of Signals is additionally governed by Section 5.

7.4 Prohibited Conduct (IP/Technical)

Without prior written permission: reverse engineering/decompilation/disassembly; removing proprietary notices; automated scraping/bulk downloads/systematic extraction; using Content to build/train/fine-tune competing models, indicators, or services ; or circumventing access/usage/payment controls.

7.5 Training Materials

Any materials provided or generated in training/coaching (see 4.6/4.7), including recordings, slides, code samples and examples , are Content. Participants shall not record, copy, redistribute or publish such materials without prior written consent.

7.6 Third-Party & Open-Source

Third-party/open-source components are governed by their own licences; where required, ZenAlgo will provide notices/source. For those components, the relevant licence prevails in case of conflict.

7.7 Feedback

If you provide ideas or suggestions, you grant ZenAlgo a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable licence to use them without restriction or obligation.

7.8 Analytics & ML (Aggregated/De-Identified)

ZenAlgo may use Content/User Content in aggregated or de-identified form to operate, secure and improve the services, including for analytics and machine learning, per the Privacy Policy and applicable law.

7.9 Enforcement & Remedies

ZenAlgo may suspend/terminate access for breach and seek injunctive relief and other remedies. No refund is due upon breach.

7.10 Notice & Takedown

ZenAlgo may remove or restrict access to (User) Content upon a compliant infringement notice and may request counter-notice per applicable law.

7.11 Residuals

ZenAlgo may use information retained in the unaided memory of personnel who had access to Content/User Content, provided this does not disclose confidential information or infringe IP.

7.12 Survival

This Section 7 survives termination/expiry of the Terms or your account.

8. Risk Disclaimer

8.1 Informational/Educational Only; No Personalization

The services, indicators, Pine scripts, tools and materials are educational/informational only and not financial, investment, legal, tax or other professional advice, nor recommendations to transact. ZenAlgo does not provide personalized recommendations or consider your objectives/financial situation/needs. You make independent decisions and assume all risks.

8.2 Compliance with Czech and EU Investment Laws

ZenAlgo operates under Czech and directly applicable EU law. ZenAlgo is not authorised by the Czech National Bank and does not perform any activity requiring such authorisation. ZenAlgo does not execute trades, safeguard client assets, provide portfolio management, investment advice, reception/transmission or execution of orders, or any other MiFID II/MiCA regulated service. Users are responsible for ensuring their use is lawful in their jurisdiction.

8.3 U.S. Law Compliance

ZenAlgo is not registered with the SEC, CFTC, NFA, or any U.S. state regulator. Where applicable, ZenAlgo relies on the publisher's exclusion under the U.S. Investment Advisers Act. ZenAlgo does not provide personalized investment/commodity trading advice, brokerage, execution, or custody services. Nothing herein is advice under U.S. federal/state law.

8.4 Hypothetical and Simulated Performance

Hypothetical/simulated results have inherent limitations and may understate risks/overstate performance due to hindsight, absence of execution slippage, liquidity constraints, latency, transaction costs/fees, or survivorship bias. No assurance any account will achieve similar results.

8.5 Testimonials

Testimonials reflect specific users' experiences and are not representative or typical; unless stated, they are not verified and are not guarantees of future performance.

8.6 General Nature Only; Professional Advice

Any content that might be read as “investment advice” is general, not tailored. ZenAlgo strongly recommends seeking independent advice from qualified financial professionals before acting.

8.7 TradingView Disclosure

Charts may be powered by www.TradingView.com. TradingView® is a registered trademark of TradingView, Inc. TradingView is not affiliated with or endorsing ZenAlgo's services.

8.8 Acknowledgement and Agreement

By using the services, you acknowledge and accept the foregoing disclaimers and risks, confirm no advisory/fiduciary relationship with ZenAlgo, and agree to use the tools and information at your own discretion and responsibility .

9. Liability; Warranties; Force Majeure

9.1 “As Is”

To the maximum extent permitted by law, the services and Content are provided “as is” and “as available,” without warranties of any kind, express, implied or statutory (including merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted or error-free operation).

9.2 No Guarantee of Results

ZenAlgo does not guarantee outcomes; users remain solely responsible for their decisions and results.

9.3 Limitation of Liability

To the maximum extent permitted by law, ZenAlgo is not liable for any indirect, incidental, special, punitive or consequential damages (including loss of profits, revenue, contracts, data, goodwill, opportunity, production, or business interruption), even if advised. ZenAlgo's aggregate liability for all claims shall not exceed the fees paid by you for the services giving rise to the claim in the twelve (12) months preceding the first event giving rise to liability.

9.4 Carve-Outs

Nothing excludes liability that cannot be excluded by law (e.g., intentional misconduct; mandatory consumer rights).

9.5 Third-Party Services & Data

ZenAlgo is not responsible for third-party services/platforms/data (e.g., payment processors, exchanges, data providers, TradingView).

9.6 Data Loss & Availability

ZenAlgo is not liable for loss/corruption/unavailability of data due to factors beyond reasonable control (outages, connectivity, provider failures, user misconfiguration).

9.7 Force Majeure

No liability for failures/delays caused by events beyond reasonable control (acts of God, outages, cyberattacks, war, strikes, government actions, or network/provider failures).

9.8 Remedies & No Refund on Breach

For breach (including Section 5 and Section 6), ZenAlgo may suspend/terminate access; no refund is due.

9.9 Survival

This Section 9 survives termination/expiry.

10. Prohibited Uses

You shall not:

  • engage in unlawful activities or violate others' rights;
  • transmit harmful, deceptive or malicious code/content;
  • access, probe or test security/vulnerabilities without written consent;
  • scrape, crawl, bulk download or systematically extract data/Content, except as expressly permitted;
  • copy, distribute, publish, resell, monetize, or mass-forward Signals or training materials; or otherwise violate Section 5 or Section 6;
  • attempt to circumvent subscription, usage, metering or payment controls;
  • use the services/Content to build, train or fine-tune competing indicators, models, or services;
  • impersonate ZenAlgo or misrepresent affiliation;
  • access accounts/areas without authorization.

Violation may result in immediate suspension/termination and other remedies.

11. Changes to Terms & Services

We may modify these Terms or the services. Material changes will be notified via the services or by email and take effect on the stated effective date (not earlier than notice, unless required by law). Your continued use after the effective date constitutes acceptance. If you do not agree, stop using the services and, where applicable, cancel before renewal. In case of conflict between these Terms and a service-specific policy (e.g., Privacy Policy, Disclaimer), the more specific document prevails for its subject matter.

12. Withdrawal Exception for Digital Content (CZE Civil Code §1837(l))

By completing a purchase, you agree that provision of ZenAlgo's digital content starts immediately after purchase and before the 14-day withdrawal period ends; therefore you forfeit the right to withdraw, unless otherwise required by law.

13. Governing Law

These Terms are governed by the laws of the Czech Republic. Disputes will be resolved by the courts of the Czech Republic. Users waive objections as to jurisdiction or venue.

14. Accuracy of Information

We strive for accuracy but do not guarantee completeness or reliability. Content is for general information only and use is at your own risk. Historical information may not reflect current conditions.
